Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Showing Mobile mobile application and the website at showingmobile.com (together, the "Service"), operated by Emisonian LLC, a Delaware limited liability company ("we", "us"). By creating an account, signing in, or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 13 years old (or 16 in the EU/UK) to use the Service. If you are under the age of majority where you live, you may use the Service only with the involvement of a parent or guardian.

2. Your account

You sign in with Apple, Google, or a phone number. You are responsible for keeping your sign-in method secure. We are not responsible for any loss arising from unauthorized use of your account; tell us promptly at help@showingmobile.com if you suspect compromise.

3. Subscriptions and one-time purchases

3.1 Tiers

We offer two recurring subscription tiers, billed monthly or annually:

We may add, remove, or change tiers and prices in the future, with notice for existing subscribers as required by the Apple / Google subscription policies.

3.2 Auto-renewal

Subscriptions are billed by Apple (App Store) or Google (Google Play) and automatically renew at the listed price each period until you cancel. To cancel, open the App Store or Google Play app on your device, find Showing Mobile under your subscriptions, and tap Cancel. To avoid the next charge, cancel at least 24 hours before the current period ends.

3.3 Refunds

Apple and Google handle refund requests for App Store / Google Play purchases. We do not have the ability to issue or deny those refunds. For refund issues, request a refund directly from Apple (reportaproblem.apple.com) or Google (Google Play refund policy). Where local law (e.g. EU 14-day right of withdrawal) requires us to issue a refund directly, email help@showingmobile.com and we will process the refund as required.

3.4 Spotlights

Spotlights are non-recurring decorations applied to a rider or horse profile, available to Fan and Pro subscribers and purchased through Apple or Google. Once purchased and applied, a Spotlight is non-refundable except where required by law or in the case of a delivery failure (e.g. payment captured but Spotlight not granted — contact support and we will make it right).

5. Show data

Show results, classes, entries, and historical records displayed in the Service are public competition records. We do our best to keep this data accurate, but we do not guarantee completeness or correctness — refer to the official results posted by the show secretary for authoritative information. The Service is informational and is not a substitute for the show's official records.

6. Intellectual property

We own the Service and its content, except for public competition records and any content you submit. By submitting content (such as a Spotlight message or photo), you grant us a worldwide, non-exclusive, royalty-free license to use, store, and display that content as needed to operate the Service.

7. Termination

You can stop using the Service and delete your account at any time from Settings → Account → Delete account, or by emailing help@showingmobile.com. We can suspend or terminate your access at any time for violations of these Terms or where required by law. After termination, Sections 3.3, 6, 8, 9, 10, and 11 survive.

8. Disclaimer of warranties

The Service is provided "as is" and "as available", without warranty of any kind. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any data displayed is accurate.

9. Limitation of liability

To the fullest extent permitted by law, in no event will Emisonian LLC, its members, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or business interruption, arising out of or relating to your use of the Service. Our aggregate liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) USD $50.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages, so the above limitations may not apply to you.

10. Indemnity

You agree to indemnify and hold Emisonian LLC harmless from any claims arising out of your violation of these Terms, your misuse of the Service, or your infringement of someone else's rights.

11. Governing law & disputes

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws rules. The state and federal courts located in New Castle County, Delaware have exclusive jurisdiction over any dispute arising out of these Terms, except where applicable consumer-protection law gives you the right to bring a claim in your local courts.

12. Changes

We may update these Terms as the Service evolves. Material changes will be highlighted at the top of this page with an updated date. Continuing to use the Service after a change means you accept the updated Terms.
